Are there tax benefits of starting a LLC in NJ if I’m not earning a ton of freelance money?

jhines1221 asked:

Hi – I earn about $3,000 a year on various freelance projects, ranging from entertainment writing to interior design. This is a relatively small portion of my income, and I’ve been listing it as ordinary income, filing 1099s and taking no deductions. I’d like to start an LLC, both to give more legitimacy to my work for my clients and to be able to take the home office / business expense deductions that I’m currently not.

I plan on doing the same volume of work and never hiring employees. Is this a smart tax move for me? Between computer equipment, the home office deduction and other expenses, I’d probably write off at least $6,000 in expenses a year. I’d love for the freelance business to take off one day, but I can’t count on it and need to base my decision on current numbers. Thanks!

Should A New York Resident Open Delaware LLC?! Please help – Read for details?

SEO Dude asked:

I am an individual living in the US (New york to be specific) and I am in the process of researching how and where to open a new LLC to operate under. I have almost made up my mind about going with Delaware for my LLC but I have a few questions and concerns before I do. First let me start with the nature of my businesses: 1. First and foremost I would like to sell services in my local area. There are no physical products exchanged, I simply design and develop websites and market the sites for the owners. 2. I will also be running various websites on the Internet which will accept paypal payments from all over the globe. So Internet Finance is another concern for the business. I will be reselling retail goods as well so I am in need of a Resellers license too How do I open a bank account in New York? Do I need a Certificate of Operation? I assume I need a Business ID number as well through delaware? (EIN?) As for accounting, how is Internet income through Paypal handled?

Can I write off the losses my llc company incurred?

James M asked:

I live in California and my LLC is taxed as a sole proprietor. I have an invention that i’ve been working on but haven’t made any sales yet. I’ve spent about $5,000 on research and design, $800.00 for the franchise tax fee, and also plan to pay for a patent soon. I am currently working a normal job making about $50,000 annually. I was wondering what if anything I can write off (e.g. R&D, franchise tax fee, patent costs, lawyer fees). Thanks for your help.

Should I be freaked out about a City business audit?

eternalsummer00 asked:

I just received a letter from the city (not IRS):

IMPORTANT NOTICE OF AUDIT for 2005-2007

Should I be freaked out? They said this is a random audit, but am I being paranoid in thinking that it is NOT random? I have not been conducting any business since October 2007 since I broke my leg when I was 9 months pregnant & have been on maternity leave ever since. Should I find a tax attorney? I have a small design business (I am the sole employee, but set up as LLC) and have not made much money. I am very freaked & don’t understand why they would be targeting someone who is just not making any money? (I need all the money I have since I have not been working since October & need to take care of my baby!)

Thanks for any advice!

What are the rights and liabililties of a small business owner?

ringo82514 asked:

My friend runs an LLC of which she is the sole employee. She does freelance engineering design, mainly fire protection for fire protection companies. She does much of her work with other small companies without signed contracts. One has decided to not pay her for services rendered. Does she have any recourse to recover these monies.

Also, the same company has decided to backcharge her for additional expenditures they had to incur because of the approval/installation process (company occasionally installed prior to full approval by all applicable parties and now has to replace some heads). My impression would be that she was hired to provide a design document and it was the other company’s obligation to approve that design and/or make sure it receives all necessary approvals. My belief is it is just a scare tactic to try to get her to back off of her demands to be paid. Again, probably would have been best to work with signed contracts, but it’s too late for that now.
